CLIENT SERVICES CONTRACT

PEOPLE INVOLVED

These terms, (the “AGREEMENT”) apply to the service or services provided, (the “SERVICE” or “SERVICE(S)”) to you, the client (the “CLIENT” or “you” or “your”) by Privé Hawaii LLC, (“my” or “I” or “COMPANY”) and is valid when you demonstrate your acceptance. We are the intended people involved in this AGREEMENT.  

 

YOUR ACCEPTANCE OF THE TERMS

When you do any of the following, you are giving your acceptance for these terms:

·   When you schedule an appointment for a SERVICE

·   When you complete payment for a SERVICE

·   When you click “I agree to the terms.”

 

SERVICES PROVIDED

The SERVICES provided include but are not limited to:  

  • Lash extensions

  • Lash perm/tinting

  • Lash extension removal

 

Payment for SERVICE(S)

You agree to pay in full for the SERVICE(S) you receive,

 

·   As listed on www.facebook.com/pg/lashes.by.mindy/services,

·   Provided  to you through email,

·   Listed prices on social media platforms,

·   Or any other reasonably available means for communicating payment

 

New Client Reservation Fee:

  • For your first 2 appointments for SERVICE, you pay a reservation fee.

  • The reservation fee is 50% of service and is required to complete the booking of your appointment date and time.

  • Your completed payment secures the date and time for your SERVICE(S).

  • If you choose to cancel your appointment, we must have at least 48 hour notice for your reservation fee to be refunded. Any cancelations beyond this will result in the loss of your reservation fee.

 

 

Existing Client Reservation Fee:

  • After your second appointment for a SERVICE, you are not charged a reservation fee to secure your appointment.

 

No-shows and Cancellations

No-shows and untimely cancellations leave gaps in my schedule that cannot be filled from the cancellation list, which in turn results in a loss of revenue. I must have 48 hour notice for cancellations or you will not be able to receive another SERVICE until you pay for 50% of the scheduled SERVICE you cancelled for. In the event of a no show/no cancelation you will not be able to receive another SERVICE until you pay 100% of the scheduled SERVICE you did not show up for.  In the event of an emergency situation or unforeseen circumstances, I may choose to waive the fee at my own discretion. Time is valuable to all of us; I hope you understand the need for these policies. If you have any questions, please do not hesitate to ask.

 

After scheduling your SERVICE(S), you may reschedule any time up to 48 hours before your scheduled appointment. Any cancellation or no-show following your scheduled appointment requires you pay for 50% of the scheduled SERVICE you cancelled for or 100% of the scheduled SERVICE you didn’t show up for.

 

Refund Policy

You are paying for my time, product, and other expenses used to provide you with a SERVICE. No refunds will be given for any reason on SERVICE(S) and or products. If you are unhappy with a SERVICE, you may contact me within 24 hours of your appointment to discuss your concerns. If a fix can be done to address your concerns, it will be done so with a complimentary 30 minute express touch up if it is at the fault of application or product.  Complimentary 30 minute touch up must be done within 10 days of initial SERVICE.  Any concerns addressed after 24 hours of your last appointment, or if you failed to follow the proper aftercare instructions, will be charged at full price for the SERVICE(S).

 

DISSATISFACTION WITH SERVICE

If you are unhappy with the SERVICE(S) you receive, then you must contact me within 24 hours following the SERVICE(S) you received to discuss the available options. You may contact me: CONTACT@PRIVEBEAUTYHAWAII.COM.

 

If you post a false or injurious statement about me and the SERVICE(S) you received publicly prior to contacting me to discuss the available options, then you risk invalidating any and all available refund options. This includes text messages, reviews on internet sites, social media platforms, and any and all other reasonably available public viewing locations.

 

I want you to be one-hundred percent pleased with the SERVICE(S) you receive from my COMPANY and will work with you to make you satisfied.

 

WAIVER OF LIABILITY

The SERVICE(S) contain built-in risks. These risks are present even when the COMPANY uses the utmost of care in its SERVICE(S) and or any products used in the delivery of those SERVICE(S). Some of these risks with the procedure and the product(s) used, include, but are not limited to: allergic reaction to the glue used to attach the eyelash extensions, eye irritation and redness, infection, discomfort, loss of natural lashes, blindness, disturbance and or disruption of vision, eye irritation, or eye pain.  

 

WARRANTY OF SERVICES

 

LIMITATION OF LIABILITY

As a CLIENT, you agree to release the COMPANY, its officers, employees, directors, and related entities from any and all damages that may result from you, the CLIENT, receiving the SERVICE(S).

 

However, if COMPANY is found to be liable, the COMPANY’s liability to you, the CLIENT, and or to any third party is limited to the amount of the most recently received SERVICE(S). Any and all claims against the COMPANY must be filed within 90 days of the date of the first claim or otherwise be forfeited forever.

 

CHOICE OF LAW/VENUE

Our AGREEMENT is governed and interpreted in accordance with the laws of Hawaii without giving effect to any principles of conflicts of law.

 

We agree to submit any dispute or controversy arising out of, or relating to this AGREEMENT to arbitration in the State of Hawaii, Honolulu according to the rules of the American Arbitration Association. The arbitration decision is binding upon us and our successors in interest.

 

SEVERABILITY

If any of the sections or terms of this AGREEMENT are determined to be invalid or unenforceable, then only that section or terms affected. The invalidity or unenforceability of a section or term does not affect the other parts or terms of the AGREEMENT.

 

ENTIRE AGREEMENT

This AGREEMENT is the entire AGREEMENT between you, the CLIENT, and me, the COMPANY for the SERVICE(S) provided. This AGREEMENT takes the place of any prior or currently existing agreements, negotiations, and or understandings that are oral or written. Any modification or change to this AGREEMENT is required by a writing signed by both of us.

 

If there is a conflict between this AGREEMENT and other information contained and or provided from me, this AGREEMENT and the terms that are in it will control and be used to resolve the conflict.

 

I hereby acknowledge that I have read, understand and agree to the terms of this document relating to Privé Hawaii LLC policies and payment of my SERVICE(S).  I represent that I am over the age of 18 years. If below 18 years of age a parent or guardian must also sign this form.
